Electronic attendance recording for building companies via Checkinatwork is now common practice in large sections of the construction sector. Since 1 April 2014, it is legally mandatory for large construction sites to notify the NSSO of the majority of employees working at the site. Since 2018, this has been made mandatory for all construction sites.
In addition, since 1 October 2014, it is mandatory for every employee to carry a ConstruBadge (construction badge) displaying their identity details and photograph. Since 1 January 2015, the NSSO is authorised to impose penalties on construction companies that do not comply with the legislation.
Legislation concerning Checkinatwork
Everyone who performs construction or other works on the construction site must check in, including:
- Employees
- Self-employed persons
- Management
- Temporary workers
- As well as architects and safety coordinators
This applies to both Belgians and foreigners. A casual visitor or client is not included in this list. An attendance record consists of the details of the employee, employer, worksite and date. If the attendance record is incorrect, penalties may be imposed on both the employee and employer. The construction site management in charge of the execution of the works holds the final responsibility in this regard. So, pay close attention to how you set up the attendance recording process with your subcontractors and employees and ensure that this system is properly established.
